Terms of Service

These terms govern the Banak web application and related restaurant services. By registering or using an account, you accept them on behalf of the person or organization operating the venue.
If you do not accept these terms, do not use Banak. Questions may be sent to info@banak.app.
1. Service
Banak provides restaurant software for table QR pages, staff calls, orders, optional payments, KDS screens, menu and restaurant settings, and operational analytics. Features may depend on the selected plan, configuration, internet access, and third-party availability.
2. Account and data accuracy
You are responsible for accurate restaurant, company, menu, pricing, allergen, tax, table, and QR-code data. Keep passwords, administrator PINs, and devices secure, and report unauthorized access promptly.
3. Restaurant responsibility
The restaurant is the seller of food, drinks, and services and remains responsible for preparation, delivery, pricing, availability, food safety, allergens, receipts, refunds, complaints, taxes, and staff conduct. Banak supplies software and does not prepare or deliver food.
4. Payments and subscriptions
Banak may offer trials and monthly or annual subscriptions. Stripe or another payment provider processes enabled online payments. The restaurant is responsible for provider verification, refunds, chargebacks, taxes, and obligations to guests. Banak does not store full card numbers.
5. Acceptable use
Do not use Banak for unlawful, deceptive, harmful, abusive, or unauthorized activity; bypass security or plan controls; access other accounts; submit unlawful data; overload the system; scrape it; attack it; or send spam.
6. Availability and changes
We aim to keep the service stable but cannot guarantee uninterrupted or error-free operation. We may change features for security, product improvement, legal compliance, or business reasons.
7. Data and privacy
Personal-data processing is described in the Privacy Policy and Data Processing Addendum. Customers must have a lawful basis for the guest, employee, menu, order, and receipt data they enter and must provide their own notices where they act as controller.
8. Limitation of liability
To the fullest extent permitted by law, Banak is not liable for indirect loss, lost profit or revenue, data loss, staff decisions, customer-entered errors, internet outages, restaurant devices, or third-party providers. Nothing excludes liability that cannot legally be excluded.
9. Termination
You may stop using Banak or request account closure. Banak may suspend or close an account for non-payment, breach, security risk, or unlawful use. Terms that must survive termination remain effective.
10. Changes to these terms
We may update these terms and will publish the current version and update date here. Continued use after publication means acceptance of the revised terms.
